SECTION 1. OVERVIEW
HOTSPOT RENTAL REQUIRED CONDITIONS
1.1 The WiFi router can be rented on the PHENIX TELECOM website : www.phenixtelecom.com. It allows users to connect to the internet using mobile phone networks of well-known international operators. The customer chooses a package and the number of days rental required. They then register on the PHENIX TELECOM website and reserve their portable WiFi router.
1.2 The minimum age required to rent a portable WiFi router is 18. When ordering online, the customer will be required to complete a registration form. They must also be in possession of a valid email address, be willing to accept the rental terms and conditions, and, in line with current French legislation, email a copy (scan or photo) of their ID card, passport or driving licence to PHENIX TELECOM (info@phenixtelecom.com).
1.3 For all rentals, PHENIX TELECOM will hold a security deposit of 150€ on the customer's credit card. This security deposit will be debited without notice to cover any costs incurred as a result of the late return, loss, or theft of the rented equipment, or any damage caused to it.
SECTION 2. RENTAL DURATION
The rental agreement between the customer and PHENIX TELECOM comes into effect at the time of order on www.phenixtelecom.com. The daily rental tariff starts and finishes on the date stipulated by the customer . Once the customer has taken physical possession of the products, all liability for loss or damage is transferred to the them. The rental contract and legal responsibilities of the customer end once all rented equipment has been returned to, and received by, PHENIX TELECOM.
SECTION 3. PROVISION
3.1 All equipment will be delivered to the address indicated by the customer at the time of order, by their chosen delivery method and on their selected date.
3.2 PHENIX TELECOM can not be held responsible for any delivery delays out of their control, (for example bad weather, transportation problems, force majeure, strike action, delays due to failure to return previous equipment, changes in delivery procedures etc), or any resulting impact (direct or indirect) this may have on the customer or other third parties. The customer will not be entitled to any compensation under such circumstances. Delivery dates are estimated and non-binding and depend upon stock availability.
3.3 The customer agrees to confirm once all equipment has been received and that it is in good working order, fit for purpose, and accompanied by detailed return instructions. Additionally they will confirm that the equipment is suitable for the needs they defined prior to their order. PHENIX TELECOM can not accept any liability should this not be the case.
SECTION 4. USAGE INSTRUCTIONS FOR PORTABLE WiFi ROUTER
4.1 The router and its accessories remain the exclusive property of PHENIX TELECOM. Under no circumstances should the customer remove or modify any property labels / inscriptions on the rented equipment, or modify/change any parts. The equipment may not be sub-let or used as collateral. The customer undertakes not to grant any right, real or otherwise, in respect of the leased object to any person likely to affect its use or limit the availability or full ownership to PHENIX TELECOM .
4.2 For the duration of the contract, the customer agrees to protect all equipment against damage, loss and theft. They also engage to ensure the equipment is maintained in good working order, and used only for its intended purpose.
4.3 In the event of equipment failure, the customer must contact PHENIX TELECOM immediately so that the internet connection can be disconnected. Contact can be made by telephone or email (info@phenixtelecom.com). All equipment should then be packaged appropriately and returned as soon as possible (by the contract end date at the very latest) to PHENIX TELECOM. The address for returns is PHENIX TELECOM, 2 rue Jean-Baptiste Marty - 94220 Charenton-le-Pont. Should the fault be due to a manufacturing fault or a force majeure event, any pre-paid credit will be reimbursed. Otherwise the appropriate deductions will be made from the security deposit provided at the beginning of the rental.
SECTION 5. SERVICE PROVISION & QUALITY
5.1 In countries covered by PHENIX TELECOM the download speed will be via 3G or 4G. The connection quality will depend on the available local operator networks. Occasionally there may be areas which have limited access or which may not be covered by local operators, for example in mountainous areas, below ground, on motorways, on remote islands or on the open sea. PHENIX TELECOM will not be liable for any temporary or permanent loss of connection to the local network, or any resulting loss or inconvenience.
5.2 PHENIX TELECOM offers an unlimited daily connection package. Once data usage passes a certain level, a fair use policy is applied. This means that the internet connection speed will be decreased to 128kbit/s (equivalent to a 2G connection). Streaming videos, downloading applications etc use a lot of bandwidth and can clog up or reduce the quality of the network. This 'fair use' policy will be applied for the rest of the 24hr period until the daily allowance is reset.
SECTION 6. PAYMENT TERMS
Rental prices for our products and services are those displayed on the day of purchase. They are payable in euros and include all taxes. Delivery and return costs are clearly indicated on the website and payable by the customer. PHENIX TELECOM reserves the right to change their prices at any time. However they engage to bill products and services at the advertised prices on display at the time of order.
Secure payment can be made by PayPal or by credit card through the PayPal website. A security deposit will also be held on the credit card.
SECTION 7. WHAT TO DO IN THE EVENT OF DAMAGE, LOSS OR THEFT
Should the router or any of its accessories be lost, stolen or damaged, the customer must contact PHENIX TELECOM as soon as possible, by email (info@phenixtelecom.com) or phone (01 48 08 80 40). The appropriate deductions will be made from the security deposit provided at the beginning of the rental.
SECTION 8. RETURN OF EQUIPMENT
8.1 The customer agrees to return all rented equipment in its original condition. They are legally responsible for all equipment until such a time as that it has been received by PHENIX TELECOM.
8.2 The customer has two working days to return all rented equipment. This should be via the French postal system using suitable protective packaging. The address for returns is PHENIX TELECOM - 2 rue Jean-Baptiste Marty - 94220, Charenton-le-Pont.
8.3 Return costs and liability are the responsibility of the customer.
8.4 Once all returned equipment has been received by PHENIX TELECOM they have a period of 48 hours to verify its condition. The customer will be informed should any previously unreported damages be found.
8.5 Customers must ensure they have proof of postage for any claims relating to the return of equipment.
SECTION 9. DELAYS OR NON-RETURN OF EQUIPMENT
9.1 Should the equipment not be returned within the timeframe stipulated, Phenix Telecom reserve the right to charge you a late payment fee equivalent to the current rental price. Additionally a replacement fee will be charged for any non-returned equipment.
9.2 Should the customer not be able to return the equipment when required, they must contact PHENIX TELECOM immediately by phone (01 48 08 80 40) or email (info@phenixtelecom.com).
SECTION 10. COMPLAINTS
Should the customer wish to make a formal complaint, they can do so by contacting PHENIX TELECOM directly by phone (01 48 08 80 40), email (info@phenixtelecom.com) or post (PHENIX TELECOM - 2 rue Jean-Baptiste Marty - 94220 Charenton-le-Pont - FRANCE).
SECTION 11. PERSONAL DATA
11.1 In accordance with current French and European legislation, PHENIX TELECOM engages to respect the protection, confidentiality and security of all personal customer data, as well as their privacy.
11.2 PHENIX TELECOM collects this data within the framework of their commercial activities, in order to authenticate their clientèle, provide the services expected of them, to satisfy management and logistical requirements, and to enable them to be able to offer products and services adapted to their customer's needs.
11.3 In accordance with the Data Protection Act, customers have the right to access any personal information held on them, and may also request such data be corrected or revised. They also have the right to oppose any information held on them.
SECTION 12. JURISDICTION CLAUSE
The local commercial courts for PHENIX TELECOM'S registered office will have exclusive jurisdiction to adjudicate any dispute arising under or in connection with this Agreement.
